Can I trademark a name that is already registered?

Generally, no. However, if the existing trademark is registered in a completely unrelated industry (a different Trademark Class), you might be able to register it for your specific goods/services, provided it is not a “well-known” trademark (like Tata or Apple).

What is the difference between ™ and ®?

You can use the ™ (Trademark) symbol as soon as you file your trademark application to claim common-law rights. You can only use the ® (Registered) symbol after the trademark certificate has been officially issued by the Government.

How long does Trademark Registration take in India?

If there are no objections from the examiner or oppositions from the public, the trademark registration process typically takes 6 to 8 months. If objections are raised, it can take 12 to 18 months or more.
